On September 2, 2025, the FCC’s Media Bureau issued new guidance on how it will process ATSC 3.0 license applications.

The Bureau reaffirmed expedited processing for stations that meet the 95% population coverage threshold, while also ensuring that non-expedited applications will be reviewed on their merits with flexibility to minimize viewer impact. The Bureau also reminded licensees that:

  • ATSC 3.0 stations only need to simulcast their primary stream in 1.0.
  • Multicast streams and advanced features (like hyper-localized or interactive content) are not restricted by “substantially similar” rules.
  • LPTV and translator stations are not required to simulcast at all, though they may do so voluntarily.

This clarification gives broadcasters greater certainty as they plan their transition strategies.

Commissioner Brendan Carr underscored the significance of this action, stating:

“Americans across the country will benefit from Next Gen TV and the improved viewing experience that it enables. Accelerating this transition will also go a long way towards ensuring that broadcasters stay competitive well into the future. That is why the FCC is working to support and encourage a timely transition. As the broadcast industry continues to evolve, we want to be sure that they can do so while maintaining their core public interest obligations. Today’s notice provides additional flexibility for broadcasters to make this transition.”
